Canadians Can Claim Part of $4.75 Million Rexulti Settlement
Canadians affected by the prescription drug Rexulti are now eligible to claim a portion of a $4.75 million class-action lawsuit settlement. The Superior Court of Quebec approved this settlement on November 12, 2023, allowing individuals who meet specific criteria to file valid claims until August 1, 2026. The Consumer Law Group announced it would represent claimants throughout the process.
The class-action lawsuit was initiated by the law firm Rochon Genova against Otsuka Canada Pharmaceutical Inc. and Lundbeck Canada Inc., with authorization granted on December 3, 2021. The lawsuit alleges that Rexulti can lead to serious compulsive behaviors and impulse control disorders, including compulsive gambling, hypersexuality, binge eating, and uncontrollable shopping. The court documents assert that the defendants failed to adequately warn patients and their physicians about these risks due to insufficient research and testing.
In addition to the lack of warnings, the plaintiffs argue that the manufacturers conspired to conceal the potential side effects, which resulted in harm to class members. While Otsuka and Lundbeck have agreed to the settlement, they have not admitted any liability.
Eligibility and Compensation Details
To be eligible for compensation, class members must have been prescribed and ingested Rexulti between February 16, 2017, and August 23, 2025. Eligible individuals include those who have taken the medication for at least one month and developed one or more of the identified compulsive behaviors. Claims must include necessary documentation, such as pharmacy records, medical files, and proof of damages.
If the $4.75 million settlement is approved, approximately $2.85 million will be allocated for compensation to approved claimants, which includes $118,750 for claims from public health insurers. Compensation amounts will vary based on the severity of the psychological harm experienced.
The proposed compensation categories are as follows:
– $6,531.25 for mild cases
– $29,687.50 for moderate cases
– $102,600 for severe cases
– $71,250 for catastrophic cases
Additionally, a total of $570,000 is reserved for claimants proving loss of income or gambling-related financial burdens due to Rexulti. Family members of affected individuals may also receive a portion of the psychological harm compensation, which is capped at $199,500.
Next Steps for Eligible Claimants
Eligible Canadians wishing to participate can register with the Consumer Law Group by completing the claim form online before August 1, 2026. The claims administrator will determine the compensation amounts, and there is an established appeals process for those who wish to contest the decisions made.
As the settlement process unfolds, individuals who believe they may be affected by Rexulti are encouraged to gather necessary documentation and consult legal resources to ensure their claims are properly filed.
