Father Files Lawsuit Against Georgia University After Daughter’s Murder
The father of Laken Riley, a 22-year-old nursing student tragically killed on the campus of the University of Georgia in Athens, has filed a wrongful death lawsuit against the Board of Regents of the University System of Georgia and several property management companies. Jason Riley alleges that the university’s negligence contributed to his daughter’s death on February 22, 2024.
The lawsuit, submitted to Gwinnett County State Court, claims that the Board of Regents “failed in its duty to provide a reasonably safe premises” and did not alert students and visitors to the potential threat posed by Jose Ibarra, the assailant who lived nearby. Just over an hour before the incident, Ibarra had attempted to enter a graduate student’s apartment on campus, looking through the window and trying to open the front door before fleeing into a wooded area.
The lawsuit highlights the circumstances surrounding Laken’s routine morning run near the Intramural Fields. It states that she was unaware of any danger, stating, “Soon thereafter, with no knowledge of the potential assailant and no reason to suspect any danger, nursing student Laken Riley went for her routine morning run.”
Allegations of Negligence and Safety Failures
In addition to the claims against the Board of Regents, the lawsuit also points to failures by the property management of the apartment complex where Ibarra resided. Jason Riley asserts that the property management failed to adequately screen tenants, allowing Ibarra to live there despite his illegal status and criminal history. The suit argues that had the property manager not permitted Ibarra to live in such close proximity to students, the tragedy could have been avoided.
The incident occurred when Ibarra, a member of the Tren de Aragua gang, attacked Laken during her run, ultimately leading to her death. Ibarra was convicted of murder and other charges and received a life sentence without the possibility of parole.
The lawsuit also alleges that the Board of Regents neglected to monitor criminal activity on campus and failed to adhere to its own policies regarding employee screening, which allowed Ibarra’s brother, also in the U.S. illegally, to be employed on the university grounds.
Impact and Legislative Response
The case has gained attention not only for its tragic details but also for its implications regarding immigration reform. Following Laken’s death, the Laken Riley Act was signed into law by President Donald Trump, marking the first legislation he enacted upon returning to the White House. This law mandates the federal detention of undocumented immigrants accused of various violent crimes.
Since the act’s implementation, officials reported that over 20,000 undocumented migrants, charged or convicted of crimes, have been detained. This legislative response has fueled ongoing discussions about immigration policy and public safety.
Jason Riley is seeking a jury trial, requesting compensatory and punitive damages, along with reimbursement for legal costs. As the case unfolds, it is poised to highlight critical issues surrounding campus safety, immigration, and accountability.
A spokesperson for the Board of Regents stated that they do not comment on pending litigation, which leaves many questions unanswered regarding the measures in place to protect students on campus.
