Driver Injured in Unsafe Lane Change Accident on Highway 99
A driver sustained injuries in a crash resulting from an unsafe lane change on Highway 99 in British Columbia. The incident occurred on the evening of February 10, 2024, when Peter Link was en route from Richmond to White Rock. The highway was covered in two to three inches of snow, creating hazardous driving conditions.
While driving, Link was overtaken by an unidentified SUV that changed lanes in front of him. This maneuver was executed with such proximity that the SUV’s tires threw snow onto Link’s windshield, obstructing his view entirely. Caught off guard, Link braked suddenly, lost control of his vehicle, and collided with the cable barrier separating the lanes.
According to the Motor Vehicle Act, drivers must adhere to specific regulations when overtaking another vehicle. Section 157 states that a driver must not return to the right side of the highway until they are safely clear of the overtaken vehicle. Additionally, Section 159 emphasizes that overtaking must be conducted safely, particularly in adverse weather conditions.
Following the incident, Link initiated legal proceedings against the unidentified driver and the Insurance Corporation of British Columbia (ICBC) for damages incurred from the crash. The case was heard by Justice Ball, who noted the significant responsibility placed on drivers when overtaking, especially under poor road conditions. Justice Ball remarked, “There is, in my view, a very heavy onus on the driver of an overtaking vehicle to make sure that passing can be done in safety; particularly in poor road and weather conditions.”
The court determined that the SUV driver breached the standard of care required in this situation, leading to Link’s injuries. Consequently, ICBC will be held accountable for settling the claim.
