B.C. Man Sentenced to Jail for Posting Ex’s Intimate Images Online

A British Columbia man has been sentenced to five months in prison for uploading explicit images and videos of his former girlfriend to Pornhub without her consent. The 42-year-old defendant, identified as B.W., pleaded guilty to one count of knowingly publishing intimate images of a person without consent. This act of revenge garnered almost 14,000 views on the platform.

The decision was made by Judge Robert McQuillan, who stated that “imprisonment is necessary” to convey a strong message of denunciation and deterrence. The judge emphasized the severity of the crime, particularly given the identifiable nature of the victim, E.H., and the public accessibility of the content.

Details of the Case

The legal proceedings revealed that B.W. and E.H. had an “on and off” relationship from April 2020 to July 2022, which was characterized by substance abuse issues, including crystal meth and alcohol. During their time together, they recorded intimate videos, but only some of these had E.H.’s consent for sharing. After their final breakup, B.W. continued to harass E.H., leading her to block his number and request no further contact.

On March 4, 2023, B.W. sent E.H. a link to a Pornhub profile featuring her name and image. He confessed in subsequent messages that he had uploaded the content and expressed feelings of being “discarded.” This prompted E.H. to contact law enforcement after discovering the explicit material on the site.

Police investigations revealed 18 videos, viewed over 10,000 times, and 80 photos, with more than 3,700 views, all clearly depicting E.H. engaging in sexual acts. Although the content was not monetized by B.W., his banking information was associated with the account.

Judicial Rationale and Sentencing

The court learned that B.W. created the Pornhub account shortly after the couple ended their relationship, with most uploads occurring between September and November 2022. The explicit content remained online until November 2023, when police intervened by contacting the platform’s administrators.

While B.W. was using crystal meth at the time of the offences, he has reportedly taken steps to address his substance abuse since then. During sentencing, Judge McQuillan acknowledged B.W.’s early guilty plea and his expression of regret. Yet, he found more significant aggravating factors, including the premeditated nature of the crime and the long duration the images were available online.

The prosecution sought a sentence of six to eight months with two years of probation, while the defence requested a conditional sentence. However, Judge McQuillan concluded that a community-based sentence would not align with the principles of justice for such a serious offence. Following his prison term, B.W. will serve 18 months on probation, during which he is prohibited from contacting E.H. and must remove any existing online content within 24 hours of his release.

This case highlights the ongoing issues surrounding the non-consensual sharing of intimate images and the legal system’s response to such violations. The judiciary aims to deter similar acts and enforce accountability for those who exploit personal relationships without consent.
