Iraq’s Prime Minister Mohammed Shia al-Sudani Steps Aside for Rival

Iraq’s caretaker Prime Minister Mohammed Shia al-Sudani has stepped aside to allow former Prime Minister Nouri al-Maliki a clearer path towards forming a new government. This decision comes after al-Sudani’s bloc secured the largest share of seats in the November 2022 parliamentary elections. According to two Iraqi officials, the maneuver was intended to resolve ongoing disputes regarding government formation.

Al-Sudani’s Reconstruction and Development Coalition won 46 seats in the 329-seat parliament, while al-Maliki’s coalition garnered 30 seats. Both leaders had sought support from the Coordination Framework, an alliance of Iran-backed Shiite parties instrumental in bringing al-Sudani to power in 2022. However, the Coordination Framework struggled to choose between the two contenders, ultimately allowing them to negotiate directly. Following discussions, al-Sudani agreed to step aside in favor of al-Maliki.

Challenges Ahead for the Incoming Government

The incoming government faces significant economic and political challenges that will require immediate attention. One of the most contentious issues is the status of the country’s armed groups, particularly the Popular Mobilization Forces (PMF). The PMF, primarily composed of Shiite militias, was formed to counter the threat posed by the Islamic State group. Although it became officially incorporated into the Iraqi military in 2016, the PMF operates with considerable autonomy.

The United States has been advocating for the disarmament of Iran-backed groups in Iraq, a complex task given their political strength. As negotiations around government formation continue, Iraq’s judiciary has become increasingly involved in the debate regarding non-state weapons. In a recent speech, Faiq Zidan, head of Iraq’s Supreme Judicial Council, stated that the defeat of terrorism has diminished the need for weapons outside state control. He emphasized that a functioning state relies on respect for law and a unified decision-making process.

Some political factions welcomed Zidan’s remarks, viewing them as an opportunity to strengthen state institutions. Conversely, armed groups reacted defensively. The Iraqi Resistance Coordination group, which includes influential factions like Kataib Hezbollah and Asaib Ahl al-Haq, issued a statement rejecting any discussions about disarmament. They portrayed their arms as essential for defending Iraq and emphasized that any dialogue on the issue should occur only after achieving “full sovereignty,” thereby dismissing what they termed foreign interference.

The Judiciary’s Role in Government Formation

Despite the opposition from some factions regarding disarmament, a judiciary official noted that Zidan has outlined a comprehensive legal framework for the disarmament process. The official, who requested anonymity due to the sensitive nature of the discussions, stated, “The refusal by some factions to disarm will not prevent the judiciary from supporting the incoming Iraqi government by providing legal cover and judicial backing for the disarmament process.”

In addition to addressing disarmament, the judiciary has taken a more assertive role in enforcing constitutional deadlines for government formation. This includes the appointment of the parliament’s speaker and the president. Political analyst Ihsan Al-Shammari from the University of Baghdad remarked that this represents one of the most significant judicial interventions in Iraq since the establishment of the current political system in 2003, following the U.S.-led invasion that ousted Saddam Hussein.
